Terms and Conditions for iPhone Giveaway
1. Eligibility
1.1 The iPhone Giveaway ("Giveaway") is open only to residents of British Columbia, Canada.
1.2 Participants must be 18 years of age or older at the time of entry.
1.3 Employees of Simply Computing, its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members are not eligible to participate in the Giveaway.
2. How to Enter
2.1 No purchase is necessary to enter or win the Giveaway.
2.2 Participants must complete the entry form available on www.simply.ca.
2.3 Only one entry per person is permitted. Duplicate entries will be disqualified.
3. Giveaway Period
3.1 The Giveaway begins on June 1 at 09:30 am and ends on June 1 at 18:00 pm ("Giveaway Period").
3.2 Entries submitted before or after the Giveaway Period will not be eligible.
4. Selection of Winner
4.1 The winner will be selected by a random draw from all eligible entries received during the Giveaway Period.
4.2 The draw will be conducted on June 3rd at 12:00 at 203-1690 West Broadway, Vancouver, BC..
4.3 The odds of winning depend on the total number of eligible entries received.
5. Prize
5.1 The prize is one (1) iPhone 15.
5.2 The prize is non-transferable and no cash or other substitution will be made except as provided herein at Simply Computing's sole discretion.
5.3 Simply Computing reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason.
6. Winner Notification
6.1 The potential winner will be notified by Email/Phone within 7 days after the draw.
6.2 The winner must respond within 7 days of the notification to claim the prize.
6.3 If the winner cannot be contacted, fails to respond within the specified time period, or is disqualified for any reason, Simply Computing reserves the right to select an alternate winner from the remaining eligible entries.
7. Publicity
7.1 By entering the Giveaway, participants consent to Simply Computing's use of their name, likeness, photograph, voice, opinions, and/or hometown and province for promotional purposes in any media, worldwide, without further payment or consideration.
8. General Conditions
8.1 Simply Computing reserves the right to cancel, suspend, and/or modify the Giveaway, or any part of it, if any fraud, technical failures, or any other factor beyond Simply Computing's reasonable control impairs the integrity or proper functioning of the Giveaway, as determined by Simply Computing in its sole discretion.
8.2 Simply Computing reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of these Terms and Conditions or in an unsportsmanlike or disruptive manner.
8.3 Any attempt by any person to deliberately undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Simply Computing reserves the right to seek damages from any such person to the fullest extent permitted by law.
9. Limitation of Liability
9.1 Simply Computing is not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Giveaway; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the operation of the Giveaway; (4) technical or human error which may occur in the administration of the Giveaway or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Giveaway or receipt or use or misuse of any prize.
10. Disputes
10.1 Except where prohibited, each entrant agrees that any and all disputes, claims, and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in British Columbia, Canada.
10.2 All issues and questions concerning the construction, validity, interpretation, and enforceability of these Terms and Conditions, entrant's rights and obligations, or the rights and obligations of Simply Computing in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of British Columbia, Canada.
11. Privacy
11.1 Information collected from entrants is subject to Simply Computing's privacy policy https://www.simply.ca/pages/privacy-policy.
11.2 By entering the Giveaway, participants consent to their email addresses being used by Simply Computing for future marketing communications. Participants can opt out of receiving such communications at any time by following the unsubscribe instructions provided in the marketing emails.
By participating in the Giveaway, you agree to be bound by these Terms and Conditions and the decisions of Simply Computing, which are final and binding in all respects.
